GiftVault's Business

GiftVault provides an online platform ("GiftVault Platform") that enables customers to discover new brands and receive exclusive gift rewards. We partner with third-party ecommerce businesses ("Publishers") who distribute reward passes to their customers, and third-party brands ("Advertisers") who provide promotional offers, gift cards, discounts, and free products ("Gifts") displayed on the GiftVault Platform (together, our "Services").

Publishers integrate GiftVault into their online stores via our Shopify application and other integrations, enabling their customers to receive reward passes automatically with qualifying purchases. As part of the Services, you may choose to sign up to receive communications from Advertisers or Publishers online (mobile web and desktop web), through email, phone, or SMS mobile text messages.

Scope of this Privacy Policy

This Policy applies to all users of GiftVault's website published at https://www.giftvault.co/, GiftVault's platform integrations, Shopify application, social media accounts, as well as GiftVault technology that is integrated on our Publishers' websites, emails, and checkout experiences that are branded "GiftVault" (collectively, "GiftVault Sites") and link to or reference this Privacy Policy.

Additionally, this Privacy Policy applies to individuals who engage with GiftVault on behalf of their company or employer in business dealings with GiftVault. This Privacy Policy does not apply where GiftVault processes your Personal Information on behalf of any Publishers or Advertisers to enable them to serve their own marketing information or promotional offers other than Gifts through the GiftVault Sites. Further, this Privacy Policy does not apply to Advertisers' fulfillment of Gifts. Please consult the privacy policies or notices of those Publishers and Advertisers to understand how they use your Personal Information.

International Data Transfer

If you use or access GiftVault Sites from outside the United States, we will store, process, and use your Personal Information in the United States. If you are located outside of the United States, you acknowledge and agree that the laws in your geographic location may differ from United States law and you agree that GiftVault may transfer your Personal Information outside of your geographic location to the United States for storage and processing. You further agree that you consent to that transfer, storage, and processing into the United States according to the laws applicable in your location.

The Choice is Yours

There is no obligation for you to sign up for or claim a Gift. When you receive a reward pass or sign up to claim a Gift, you may provide us with your Personal Information (as set forth in "Ways We Collect Your Personal Information").

By providing us your Personal Information, you consent to us collecting, storing, and using that Personal Information as set forth in this Privacy Policy. We may share your Personal Information, where applicable, with the Advertiser offering the Gift so that they may provide further information associated with such Gift, and then fulfill such Gift. There are no negative consequences if you do not claim a Gift.

Ways We Collect Your Personal Information

1. When You Give It to Us or Give Us Permission to Obtain It

When you engage with the GiftVault Sites and our Services, you may provide us with your name, email address, phone number, and other Personal Information that you provide to us in conjunction with your activation and selection of a Gift through the GiftVault Sites.

When you create a GiftVault account, you provide your contact information, including name and email address and other identifiers that you choose to provide, as well as authentication information for your login (such as a password).

If you interact with GiftVault on behalf of your business or employer in conjunction with an actual or potential business relationship, we will collect Personal Information in the course of managing the relationship, including your contact information, history, as well as account login information and account activity.

You may provide Personal Information when you communicate with us, including if you engage in our surveys or feedback requests, and if you contact customer support. We also collect details of communications that we send you (such as via email, text messages, etc. or within the GiftVault Sites). You may also provide information to us through social media, including if you interact or comment with any of our social media accounts.

2. Our Publishers and Advertisers Share Information with Us

Personal Information about you may be provided to us by Publishers and Advertisers as part of our Services to them. For example, when you complete a purchase on a Publisher's online store, the Publisher may share your name, email address, phone number, and order information with GiftVault so that we can issue and deliver your reward pass. We also receive information associated with whether and when you claim or redeem Gifts from our Advertisers, including information to help us better understand what kinds of Gifts may interest you.

3. We Also Get Technical Information When You Use the GiftVault Sites

We may collect certain information about your device when you interact with the GiftVault Sites, including device identifiers (your browser type, whether you are on a desktop, laptop, or mobile device), and information about your interactions with us while using the device (such as your clicks on content and page views while on our website only). Additionally, device and analytic information may be retrieved from your device/web browser, which may include, among other things, your IP address, browser type/version, and/or general geolocation information based on your IP address.

We may collect your history about your interactions with the GiftVault Sites, including the Gifts you view, select, activate, and redeem, as well as communications sent on behalf of GiftVault, Advertisers, or Publishers. This includes, among other things, information relating to Gift interaction, including click-through rates and viewing data.

We may infer data about you, including your location from your IP address. We may collect relationship information that helps us to understand who you are so that we may better match you with Gifts you might like, including demographics, lifestyle preferences, and the types of offers that interest you.

How, When, and Why We Use Your Personal Information

As described above, GiftVault's Services include connecting our Publishers' customers with offers of Gifts from our Advertisers. The GiftVault Sites display Gifts from Advertisers and allow you to claim and redeem such Gifts. The following details the purpose for using your Personal Information as well as the basis on which we disclose information to our Publishers, Advertisers, and other third-party processors.

1. Use of Personal Information by GiftVault

We may use your Personal Information for certain purposes, including:

• Provide, maintain, and improve the GiftVault Sites, including features and functionalities.
• Manage our everyday business needs such as website administration, analytics, and security.
• Facilitate our business, including integrating Publishers, onboarding and activating Advertisers, generating marketing and promotional campaigns to introduce our Publishers' customers with offers of Gifts from our Advertisers through the GiftVault Sites.
• Issue, deliver, and manage reward passes to eligible customers.
• Evaluate and personalize the types of Gifts that may be of interest to you so that we may provide you with more relevant Gifts based on your preferences and personal characteristics.
• Analyze and understand how you use the GiftVault Sites, including, but not limited to, tracking selection and redemption of Gifts.
• Evaluate or conduct a potential or actual business relationship if you engage with us on behalf of an employer or company.
• Audit the Services.
• Send marketing and informational messages, which may include having third parties send emails on our behalf.
• Investigate and respond to any customer service inquiries you might have.
• Communicate and provide additional information which may be of interest to you about GiftVault, our Publishers, and Advertisers, such as marketing materials, reminders, technical notices, updates, support, and security alerts.
• Administer surveys or other promotional activities.
• Evaluate or participate in potential or actual mergers or acquisitions with third parties.
• Promote safety, security, and fraud prevention through the GiftVault Sites.
• Comply with applicable laws and enforce our policies.

2. Disclosure of Your Personal Information

We may disclose your Personal Information, including name, email address, and other information you give us, to Advertisers when you select or claim their Gifts for the purposes of gift fulfillment and tracking.

We may disclose your Personal Information, including name, email address, other information you give us, and information pertaining to Gifts you view or select, to Publishers who direct you to the GiftVault Sites for the purposes of tracking and analytics.

GiftVault may also disclose information about you that does not identify you personally. For example, we may provide our Advertisers, Publishers, or other third parties with reports that contain aggregated data, statistical data, and/or anonymized data.

We retain employees and certain service providers to assist us in processing your Personal Information in accordance with our instructions and solely as necessary to perform the Services and manage our business.

We may be required to provide Personal Information to legal authorities or others as necessary to (i) comply with a law, regulation, or legal request (including requests related to national security or law enforcement requirements), (ii) protect the rights or property of a third party or GiftVault, or (iii) detect, prevent, or otherwise address fraud, security, or technical issues related to the Gift process.

Your Rights and Choices

Depending on where you live, you may have the right to correction/rectify/delete your Personal Information, to opt out of certain targeting practices, or to withdraw consent for processing where you have previously provided consent. Below we explain how to exercise these rights:

Accessing, Changing, or Deleting Your Information

You can access your information and change, correct, or delete certain Personal Information that GiftVault collected about you. By sending an email to [email protected], you can: (i) request a copy of the Personal Information GiftVault maintains about you, or (ii) request that GiftVault change, correct, or delete the Personal Information that GiftVault has collected about you. You may also request deletion of your account and Personal Information.

Deleting Your Account

You may delete your account at any time by sending a request to [email protected]. We may also retain certain information about you for legitimate business purposes and/or if we believe doing so is in accordance with, or required by, any applicable law.

Advertisers and Publishers

You may opt out of GiftVault providing your Personal Information to Advertisers and Publishers. To do so, send an email to [email protected]. If you opt out of GiftVault providing your information to Advertisers, you must provide your information to the Advertisers directly in order for your Gifts to be fulfilled.

We believe that you benefit from a more personalized experience when we know more about you and the kinds of offers you like. However, you can limit the information you provide to GiftVault or that GiftVault provides to others. You can also limit the communications that GiftVault sends to you, as follows:

Email

You may manage your email preferences by clicking "unsubscribe" on or opting out of any email communication we send you. You may choose to subscribe to some types of messages and may choose to unsubscribe from others.

Cookies

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, and you may manage how your browser or mobile device handles cookies and related technologies by adjusting its privacy and security settings. Please note that if you disable cookies, you may be unable to participate in certain features of our Services. If you want to disable all cookies, you need to change your website browser settings to reject cookies.

Mobile

You may adjust the settings on your mobile device to prevent the sharing of precise GPS location-based information. You may also manage how your mobile device or mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings.

SMS

By providing us with your mobile telephone number, you consent to receive SMS text messages at that number as requested for the provision of Gifts and other purposes related to the Services. You can stop receiving SMS messages at any time by texting "STOP" to the text message that we sent you. After this, you will no longer receive SMS messages from us.

GiftVault does not discriminate against users for exercising their rights under data protection laws.

Security

We use reasonable administrative, logical, physical, and managerial measures to safeguard your Personal Information against loss, theft, and unauthorized access, use, and modification. These measures are designed to provide a level of security appropriate to the risks of processing your Personal Information. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your Personal Information.

Retention of Personal Information

We may retain Personal Information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or invoicing records purposes with Publishers and Advertisers, and as otherwise necessary to fulfill the purposes described in our contractual agreements and this Privacy Policy. We take reasonable measures to delete, destroy, or de-identify Personal Information in a secure manner as appropriate or required.

Our Commitment to Children's Privacy

We do not knowingly collect, maintain, or use information from children under 16 years of age, and no part of the Services are knowingly directed to children. GiftVault encourages parents and guardians to monitor their children's activities online. If you learn that a child has provided us with their information in violation of this Privacy Policy, please alert us at [email protected].

Automated Decision Making

We do not use automated decision-making without human intervention, including profiling, in a way that produces legal effects concerning you or otherwise significantly affects you.

Changes and Updates to this Privacy Policy

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when posted.
